Consumer Health Data Privacy Notice

This notice to consumers who reside in Washington and Nevada is provided under relevant US state consumer health data laws, including the Washington My Health, My Data Act (HB 1155) and the Nevada consumer health data law (SB 370), all associated amendments and updates, and any similarly applicable US state consumer health data laws (collectively, the “US State Consumer Health Data Laws”). This notice supplements our Privacy Policy for Consumer Services and applies solely to personal data defined as “consumer health data” subject to the US State Consumer Health Data Laws, from Washington and Nevada consumers that use or interact with our Consumer Services or whose personal data we obtain from third parties. This notice does not apply to individuals in their professional capacity as a representative of an enterprise customer, business partner, data supplier, developer or vendor (for this, please see our Privacy Policy for Developer & Enterprise Services instead), or in their capacity as an employee or job applicant.

Data We Collect

The types and sources of personal data (which may include consumer health data) we collect are detailed in the Personal Data We Collect and Process section of our Privacy Policy for Consumer Services.

The data we collect depends on the context of your interactions with Foursquare and the choices you make (including your privacy choices), the Consumer Services and features you use, your location, and applicable law (including any US State Consumer Health Data Laws). Because consumer health data is defined very broadly, some of the categories of personal data we collect may also be considered consumer health data. Examples of consumer health data may include:

– Precise location data that may indicate your attempt to acquire or receive health services or supplies. For example, if you use our Consumer Services (such the Foursquare City Guide mobile app) to look up a healthcare provider or facility, we may collect precise location data that could reveal such health-related information.

– Other information that may be used to infer or derive data related to the above or other health information.

We may collect such data directly from you based on your interactions with our Consumer Services, or from third parties.

How We Use Your Data

We may collect and use data as reasonably necessary to provide you with the Consumer Services you have requested, which may include delivering and operating the Consumer Services and their features, ensuring the secure and reliable operation(s) of the Consumer Services and the systems that support them, improving the Consumer Services, and other business operations that support the provision of the Consumer Services. 

We may use data for those or other purposes (e.g., aggregated products and services) for which we give you choices and/or obtain your consent as required by applicable law (including any US State Consumer Health Data Laws). Disclosing Your Data

We may share data (which may include consumer health data), with your consent or as reasonably necessary to provide the Consumer Services you have requested. For instance, your data will be shared with others on the Consumer Services if you upload content (e.g., photos, comments or tips) that is visible to others. We may share your data with certain third parties, such as service providers, who assist us in providing the Consumer Services. Further, we may also disclose data when we believe that doing so is necessary to comply with applicable law (including any US State Consumer Health Data Laws) or respond to a valid legal process.
